Welcome to JRW Estimating & Surveying. These Terms and Conditions govern your use of our services. By engaging our services, you agree to these Terms and Conditions.
1. Definitions
1.1 "Company," "we," "our," or "us" refers to JRW Estimating & Surveying.
1.2 "Client," "you," or "your" refers to the person or entity receiving services from JRW Estimating & Surveying.
1.3 "Services" refer to any estimating or quantity surveying services provided by JRW Estimating & Surveying.
2. Scope of Services
2.1 The services provided are strictly professional in nature and are based on the scope agreed upon in the proposal or contract.
2.2 We reserve the right to refuse or modify services if the scope is unclear or exceeds our area of expertise.
2.3 Any additional work beyond the agreed scope will be subject to additional fees.
3. Client Responsibilities
3.1 The client shall provide accurate and complete information required for the services.
3.2 Delays caused by incomplete or inaccurate information from the client may affect project timelines.
3.3 The client is responsible for reviewing and confirming the accuracy of all deliverables.
4. Fees and Payment
4.1 All services are charged at the rates agreed upon in the proposal or invoice.
4.2 Payment terms will be specified in the invoice and must be adhered to. Late payments may incur additional charges.
4.3 JRW Estimating & Surveying reserves the right to suspend services if payments are overdue.
5. Confidentiality
5.1 All client information shared with us will be treated as confidential.
5.2 We will not disclose any confidential information to third parties without the client’s written consent, except as required by law.
5.3 The client agrees to keep any proprietary methods or templates provided by JRW Estimating & Surveying confidential.
6. Liability and Disclaimer
6.1 While we strive for accuracy, JRW Estimating & Surveying is not responsible for financial or contractual losses arising from the use of our services.
6.2 The client is responsible for verifying the suitability and accuracy of our deliverables before implementation.
6.3 Our liability for any claims shall be limited to the fees paid for the services rendered.
7. Cancellations and Refunds
7.1 Clients may cancel services with written notice. Any work completed before cancellation is chargeable.
7.2 Refunds will be issued only at our discretion and in accordance with the agreed terms.
7.3 If JRW Estimating & Surveying cancels a service, a full or partial refund may be provided.
8. Intellectual Property
8.1 Any reports, estimates, or documents provided by JRW Estimating & Surveying remain our intellectual property until full payment is received.
8.2 Clients may use deliverables only for the intended purpose and may not reproduce, distribute, or resell them without prior consent.
9. Fore Majeure
9.1 JRW Estimating & Surveying shall not be liable for any delays or failure to perform services due to unforeseen circumstances beyond our control, including but not limited to natural disasters, pandemics, government regulations, or technical failures.
10. Dispute Resolution
10.1 Any disputes shall first be attempted to be resolved amicably.
10.2 If resolution is not achieved, disputes shall be subject to arbitration in accordance with the laws of England, Wales, Scotland, and Northern Ireland.
11. Governing Law
11.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England, Wales, Scotland, and Northern Ireland.
12. Amendments
12.1 JRW Estimating & Surveying reserves the right to update these Terms and Conditions at any time. Clients will be notified of significant changes.
